1. Acceptance of Terms

By visiting kairovaclothing.com, creating an account, or placing an order with KAIROVA ("we", "us", "our"), you agree to these Terms & Conditions. If you do not agree, please do not use the site or place orders through it.

These terms apply to everyone who accesses the store: shoppers, account holders, and visitors.

2. Eligibility & Accounts

You must be at least 13 years old to use the site. When you create an account, you agree to provide accurate information and to keep your login credentials confidential — you are responsible for all activity under your account.

We may suspend or close accounts that provide false information, abuse the store, or engage in fraudulent activity.

3. Products, Stock & Pricing

KAIROVA operates on limited production runs. Placing an item in your bag does not reserve stock — stock is only secured once checkout payment is completed. Items in your bag may sell out before you pay, and we cannot hold reserved inventory.

All prices are listed in Ghana Cedis (GHS) and include applicable taxes unless stated otherwise. Delivery fees are calculated at checkout based on your selected region and shown before you pay.

We make every effort to display products and colours accurately, but colours can vary slightly by screen. Product descriptions and specifications may change as we improve garments between runs.

4. Orders & Payment

When you place an order, you are making an offer to buy. You will receive an order confirmation by email, and your order is accepted once payment is confirmed through Paystack.

All card and Mobile Money payments are processed by Paystack. We never see or store your full card or wallet credentials. If a payment fails, is reversed, or is flagged as fraudulent, we may cancel the order and refund the amount paid.

We reserve the right to cancel any order before dispatch — for example, if an item sold out, a price was listed in error, or a payment could not be verified — with a full refund of any amount charged.

5. Delivery & Fulfilment

We currently deliver within Ghana to all regions through our courier partners. Delivery times typically range from 24–48 hours depending on your region; remote areas may take longer.

Delivery fees are calculated per region and shown at checkout. Couriers will contact you on the phone number provided at checkout — please ensure your number and address are correct, as failed deliveries caused by incorrect details may incur re-delivery fees.

Risk in the goods passes to you when the parcel is delivered to the address you provided.

6. Exchanges, Returns & Cancellations

Exchanges are accepted within 7 days of receipt for unworn garments with original brand tags intact, subject to stock availability. To start an exchange, contact us on WhatsApp or through the contact form with your order reference.

Because of hygiene and the limited nature of our runs, we cannot accept returns of worn items, washed items, items without tags, or gift cards.

If your garment arrives damaged or incorrect, contact us within 48 hours of delivery with photos and your order reference, and we will make it right with an exchange or refund.

Once an order is placed and paid, it cannot be cancelled after dispatch; please contact us immediately if you need to make a change.

7. Intellectual Property

All content on this site — including the KAIROVA name and logo, garment designs, artwork, photography, lookbooks, text, and the overall look and feel of the site — is the property of KAIROVA and is protected by copyright and trademark law.

You may not copy, reproduce, distribute, sell, or create derivative works from our designs, images, or content without our prior written permission. Reselling KAIROVA garments commercially requires a written agreement with us.

8. Acceptable Use

You agree not to misuse the site: no scraping, automated purchasing bots, attempting to gain unauthorised access to accounts or systems, interfering with the site's operation, or submitting false or abusive messages through our forms.

You are responsible for any content you submit (for example, review or contact messages) and must not submit unlawful, defamatory, or infringing material.

9. Third-Party Services & Links

The store relies on third-party services — Paystack for payments, couriers for delivery, and social platforms we link to. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their content or practices.

10. Disclaimers & Limitation of Liability

The site is provided "as is" and "as available". We work hard to keep it fast, secure, and accurate, but we do not guarantee that it will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, KAIROVA is not liable for indirect, incidental, or consequential damages arising from your use of the site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these terms limits liability that cannot be limited under Ghanaian law, including liability for fraud or for death or personal injury caused by our negligence.

11. Governing Law

These terms are governed by the laws of Ghana, and any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Ghana. Where consumer protection laws in your location give you rights that these terms do not override, those rights continue to apply.

12. Changes & Contact

We may update these terms from time to time; the "Last updated" date above reflects the latest version. Changes take effect when posted, and continued use of the store after that means you accept the updated terms.
